By creating an account on HeyElroy or otherwise accessing or using the service, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the service.
You must be at least 18 years of age to create an account or use HeyElroy. By using the service, you represent and warrant that you meet this age requirement. Users who are parents or legal guardians of minors must provide express consent if they allow their child to use the service under their supervision.
HeyElroy reserves the right to modify these Terms of Service at any time. Updated terms will be posted on this page with a revised "Last updated" date. Your continued use of the service after any changes constitutes your acceptance of the updated terms.
HeyElroy is an AI-powered product identification and listing generation platform designed for resale marketplaces. The service enables users to scan items using product photos, receive AI-generated identification and pricing analysis based on comparable sales data, generate marketplace-ready listings for multiple platforms, manage inventory, and optionally host a storefront for direct sales.
Service availability is provided on an "as available" basis. HeyElroy may perform scheduled or unscheduled maintenance that temporarily affects service availability. We will make reasonable efforts to minimize downtime but do not guarantee uninterrupted access.
You are responsible for maintaining the security of your account and all activity that occurs under it. You agree to notify HeyElroy immediately of any unauthorized use of your account.
Each individual may maintain only one HeyElroy account. Creating multiple accounts to circumvent usage limits, exploit promotions, or for any other purpose is prohibited.
HeyElroy reserves the right to suspend or terminate accounts that violate these Terms of Service, at our sole discretion, with or without prior notice.
You may delete your account at any time through the Settings page. Account deletion is permanent and irreversible. Upon deletion, all personal data is removed and any active subscriptions are cancelled.
Paid subscriptions are billed on a monthly basis through Stripe. By subscribing, you authorize recurring charges to your selected payment method until you cancel your subscription.
Subscription tiers (Starter, Pro, Elite) provide different allocations of scan credits per billing cycle. Unused scan credits do not carry over to the next billing cycle, except for rollover credits which are preserved for up to 90 days after subscription cancellation.
Upon cancellation, your access continues until the end of the current billing period. After 90 days of inactivity following cancellation, any remaining rollover credits expire permanently.
Add-on packs (additional scan credits purchased outside your subscription) are non-refundable once purchased and are consumed before subscription credits.
Storefront subscriptions are billed separately, either as a standalone plan or as an add-on to an existing subscription. A platform transaction fee of 2.6% applies to all storefront sales and is automatically deducted from the sale amount during Stripe payment processing.
You agree not to use HeyElroy for any unlawful purpose or in violation of these terms. Specifically, you must not:
HeyElroy reserves the right to remove listings, suspend accounts, or take other appropriate action against users who violate these policies.
AI-generated listing content — including titles, descriptions, and pricing suggestions — created by the service may be freely used by the account holder for their resale activities on any platform.
HeyElroy retains no ownership of images you upload. Your images remain your property.
The HeyElroy brand, name, logo, interface design, proprietary algorithms, and all associated intellectual property remain the exclusive property of HeyElroy and may not be copied, reproduced, or used without express written permission.
HeyElroy's AI generates original metadata, descriptions, and market analysis that are transformative in nature and do not serve as a substitute for the original marketplace listings from which data is derived. All AI-generated content constitutes new, original works created through automated analysis and synthesis.
AI-generated pricing suggestions are estimates derived from publicly available market data and comparable sales. They are not guarantees of sale price, market value, or the condition of any item. Actual sale prices may vary.
Authentication assessments provided by HeyElroy are AI-generated opinions based on visual analysis. They are not professional authentication certifications. You should not rely solely on HeyElroy for authentication of high-value or luxury items. HeyElroy is not liable for losses arising from reliance on authentication assessments.
HeyElroy is not responsible for the accuracy, completeness, or timeliness of third-party marketplace data used in pricing analysis.
The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by applicable law, HeyElroy's total liability for any claims arising out of or related to these terms or the service shall not exceed the total amount paid by you to HeyElroy in the 12 months preceding the event giving rise to the claim.
Sellers who operate a HeyElroy storefront are solely responsible for the accuracy of their listings, the quality and authenticity of their items, and the fulfillment of all orders placed through their storefront.
HeyElroy acts as a platform provider and is not a party to transactions between buyers and sellers. HeyElroy does not inspect, verify, or guarantee any items listed on storefronts.
Buyers transact directly with sellers. HeyElroy is not responsible for disputes, refunds, or issues arising between buyers and sellers. Disputes should be resolved directly between the parties involved.
All payment processing is handled by Stripe. HeyElroy does not store credit card numbers or sensitive payment information at any time.
Your use of HeyElroy is subject to our Privacy Policy, which describes how we collect, use, and protect your data.
Product images and market data are anonymized and retained to improve service accuracy, authentication capabilities, and market analysis. For full details on data retention and your rights, please review the Privacy Policy.
HeyElroy may terminate or suspend your access to the service at any time, with or without cause, for violation of these terms or for any other reason at our sole discretion.
You may terminate your account at any time through the Settings page. Upon termination, your personal data is permanently deleted and any remaining market data is anonymized in accordance with our Privacy Policy.
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.
Any disputes arising out of or relating to these terms or the service shall be resolved through binding arbitration in Duval County, Florida, in accordance with the rules of the American Arbitration Association. Each party shall bear its own costs in any arbitration proceeding.
HeyElroy operates an Error Bounty Program to reward users who identify substantial pricing inaccuracies or data quality issues in our AI-generated results. We believe our users are our best quality assurance partners.
What qualifies: Reports of significant pricing discrepancies, incorrect item identifications, misattributed market data, or systematic errors that affect the reliability of scan results. Minor variations in pricing estimates do not qualify, as market data is inherently approximate.
How to report:Use the "Report pricing inaccuracy" link at the bottom of any scan result, or contact us through our Contact page. Include as much detail as possible about the inaccuracy you observed.
Rewards:Verified reports may be rewarded with bonus listing credits or deep scan credits at HeyElroy's discretion. The first user to report a verified issue receives priority consideration. Rewards are non-transferable and have no cash value.
HeyElroy reserves the right to modify, suspend, or discontinue the Error Bounty Program at any time without prior notice. Determination of whether a report qualifies and the reward amount are at HeyElroy's sole discretion.
