HeyElroy Store Terms

Version 2026-10-10

These Store Terms cover buying and selling on HeyElroy store pages. They apply on top of the HeyElroy Terms of Service and Privacy Policy. If something here conflicts with those for store sales, these Store Terms win. By using a HeyElroy store as a buyer or a seller, you agree to them.

1. Who we are and what we do

HeyElroy (“we,” “us”) provides a website where sellers can set up a store page and where buyers can check out. We are a venue. We are not the seller, and we are not a party to any sale between a buyer and a seller. The seller sells the item. We do not own, inspect, store, ship or guarantee any item, and we do not guarantee that any listing is accurate.

2. The seller is the merchant

Each seller is the “merchant of record” for their sales. This means the seller is the business the buyer is paying. Payments go directly to the seller’s own Stripe account. The buyer’s card statement will show the seller’s details, and the seller is responsible for the sale, the item, the refund, and any dispute.

3. Seller accounts and Stripe

To sell, you must (a) have an active HeyElroy storefront subscription, (b) be at least 18 and able to enter a contract, (c) connect your own Stripe account, and (d) keep it open and in good standing. Your use of Stripe is governed by the Stripe Connected Account Agreement and Stripe’s Services Agreement. By connecting, you accept them. Stripe, not HeyElroy, holds your funds, pays you out, and verifies your identity. We cannot release, reverse or recover your money. Stripe’s processing fees are charged to you by Stripe.

4. Our fee

We charge sellers a platform fee of 2.1% of the item price plus shipping on each order. It is taken automatically from the payment at the time the order is paid, through Stripe’s application fee feature, and shows in your Stripe dashboard. This is separate from your HeyElroy subscription and from Stripe’s fees. We may change the fee on 30 days’ notice; the new fee applies to orders placed after that date.

5. Prices and descriptions

Sellers set their own prices. For now, checkout does not add a separate shipping charge, so a seller’s prices should already include shipping. Sellers must describe items honestly and show condition, flaws and size accurately.

6. Taxes

Sellers are responsible for their own taxes, including income tax and any sales or use tax they owe, and for tax registrations and returns. Stripe, not HeyElroy, reports seller income to the IRS where required (for example on Form 1099-K). We record the state each order ships to. If a law requires us to collect and pay sales tax on orders placed through HeyElroy, we may add that tax at checkout and will update these terms.

7. Shipping

The seller ships the item. Sellers must ship within the time stated on the listing, or within 5 business days if no time is stated, using a method with tracking where the item is worth more than $50. The seller is responsible for packing, shipping costs, and loss or damage in transit unless the listing states otherwise. Buyers must give a correct shipping address. We don’t handle shipping or insurance.

8. Checkout hold

When a buyer starts checkout, we hold the items for 10 minutes so no one else can buy them. If payment is not completed in that time, the hold ends and the items may go to another buyer. A hold is not a sale. A sale is complete only when the payment succeeds. Our site is built to prevent the same item being sold twice, but if a problem order ever happens (for example, a payment arrives just as a hold ends), the seller resolves it with the buyer, including a refund where one is due.

9. Returns and refunds

Returns and refunds follow each seller’s own policy; buyers should contact the seller to ask about it. The seller decides and handles refunds, from their own Stripe dashboard. Where a seller has no policy, the buyer should assume sales are final except where the item is not as described, does not arrive, or the law requires otherwise. We may help communicate but we aren’t obliged to decide who is right.

10. Disputes and chargebacks

If a buyer disputes a charge with their bank (a “chargeback”), Stripe takes the disputed amount and any dispute fee from the seller’s Stripe balance. The seller is responsible for responding to the dispute and for the loss if it is lost. HeyElroy is not responsible for chargebacks or the buyer’s loss. If a seller’s balance cannot cover it, that is between the seller and Stripe. Buyers and sellers should try to settle any disagreement directly before going to a bank or court. We may remove a seller who has repeated disputes.

11. Our fee on refunds

If a seller refunds an order, we keep our 2.1% fee on the amount refunded, unless the refund was caused by a mistake or technical error of HeyElroy (for example, a double charge from our checkout). In that case, we will return our fee on that order. To ask, contact us through the Contact page within 30 days.

12. Prohibited items

You may not list, sell or buy: stolen, counterfeit or knock-off goods; illegal drugs, drug paraphernalia, or anything controlled; firearms, ammunition, explosives, and weapons parts; recalled products; adult or sexually explicit material; items that infringe someone’s copyright, trademark or other rights; human remains or body parts; live animals; tobacco, vaping products and alcohol; prescription drugs or medical devices; gift cards and stored-value cards; lottery tickets; digital goods or services (the store is for physical used and resale goods only); personal data; items that you cannot lawfully sell or ship; and anything on Stripe’s list of prohibited and restricted businesses. We can remove any listing at our discretion.

13. Seller conduct

Be honest. Use only photos you have the right to use. Don’t manipulate prices or reviews, don’t take buyers off-platform to avoid fees, don’t harass anyone, and don’t use the store for anything illegal.

14. Suspension and closing accounts

We can remove listings, pause a store, or close an account at any time, with or without notice, if we believe you broke these terms, put buyers at risk, caused or are likely to cause chargebacks, or if required by law or by Stripe. If we close an account, orders already paid stay the seller’s responsibility to fulfil or refund. Sections that by nature continue (fees owed, disputes, liability, law) survive closure. You may close your store at any time after fulfilling open orders.

15. No warranties

HeyElroy and its store features are provided “as is” and “as available.” We don’t promise that the service will be uninterrupted or error-free, or that any buyer or seller will behave well. We don’t guarantee any item.

16. Limit on our liability

To the fullest extent the law allows, HeyElroy is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost sales or lost data, arising from the store, any sale, or any item. Our total liability for any claim related to the store is limited to the greater of $100 or the total store fees you paid HeyElroy in the 12 months before the claim. Nothing here limits liability that cannot be limited by law. Sellers agree to defend and reimburse HeyElroy for claims, losses and costs arising from their listings, items, sales, taxes, or breach of these terms.

17. Privacy

Buyer information (name, shipping address, email) is shared with the seller for fulfilment. Sellers may use it only to fulfil and support the order and not to spam or sell it. See our Privacy Policy.

18. Governing law and disputes

Florida law governs these Store Terms, without regard to conflict-of-law rules. Any legal claim against HeyElroy must be brought in the state or federal courts located in Florida, and you consent to those courts.

19. Changes to these terms

We may update these Store Terms. For material changes, we’ll give at least 14 days’ notice by email or on the site. New terms apply to orders placed after the effective date. Using the store after that date means you accept the update.
